Insurance services specialists A.M. Best Co. has released the latest installment of the Insurance Law Podcast, a series that examines timely insurance issues from an attorney’s point of view.

This episode features attorney Daniel Raab from the law firm of Daniel W. Raab, P.A. in Miami, FL. Mr. Raab, who has practiced law in Florida for more than 20 years, has served as Adjunct Professor at St. Thomas University School of Law, University of Miami School of Law and Florida International College of Law. He is the author of Transportation Terms and Conditions and a contributing author of Goods in Transit.

Raab discusses a cargo transportation case dealing with damage from improper loading and the limitation of liability. He explains how COGSA, the U.S. Carriage of Goods by Sea Act, relates to this case, how the “Himalaya Clause” affected the decision and if an appeal seems likely. Raab also sets forth what insurers should know about cargo cases and which pending cargo transportation cases bear watching.
